It’s a New 10, LLC ("Company", "we", or "our") is committed to advising you of your rights to privacy and strives to provide a safe and secure user experience.  This Privacy Policy describes how we collect, secure, use, and disclose our customers’ Personal Information.  It also describes your rights and the choices you have regarding your Personal Information and how to contact us to answer any questions you may have about our use of your Personal Information. 

Please note that this Privacy Policy is limited to customers utilizing our Website in the United States and applies to the Personal Information we collect both online and offline, when you access or use our website, mobile app, social media, or when you contact us with any questions. If you disagree with the way we collect and process Personal Information, please do not use our services.

1.1.      We collect various types of Personal Information about you when you visit and use our Website; examples include identifiers, order information, payment information, demographic information, behavioral information, and indirect information.  We also collect inferences drawn from or created based on any of the information identified below.  Sometimes we collect combinations of these types of information:

1.1.1.   Identifiers.  Is information that can be used to identify you.  This is information which you are prompted to provide to us.  Such information may include your name, social media identification, username, address, telephone number(s), mobile numbers, email address, or other unique information about you which you provide to us during the registration process, or through the course of communicating with us about the products and services provided on our Website.  

1.1.2. Order information. Is information we collect to process your orders or otherwise provide you with our products and services. Such information may include your purchase, return, exchange, or preferences information.  It may also include your beauty profiles you provide to us such as hair color and type.    

1.1.3. Demographic Information.  Is information that may or may not be unique to you in the sense that it refers to selected population characteristics.  Such information may include, but is not limited to, zip code, mobile phone carrier, age, gender, salary range, education, marital status, occupation, gender, race, and ethnicity.  We may also collect your general geolocation and personal online interests.  When we can identify you personally through the use of this information, it becomes Personal Information.

1.1.4.   Behavioral Information.  Is information which is automatically collected when you use our Website.  This information may be collected by us or a third-party.  This information includes the areas of our Website that you visit, what services you access or ordered, information about your computer hardware and software, including your IP address, geographic location, browser preference, operating system type, domain names, times that you access the internet, and other websites you have visited.  It allows us to draw certain inferences about you such as what products you like, where you live, what concerns or solutions you are looking for.  This allows us to manage and display advertisements tailored to your interests.  When we can identify you personally through the use of this information, it becomes Personal Information.

We have no access or control over these cookies and other tracking devices used by third-parties, including advertisers and networks, internet service providers, data analytics providers, or social networks and platforms.  We have no responsibility or liability for the policies and practices of these parties.  When we can identify you personally through the use of this information, it becomes Personal Information.

1.1.6.   Web Technology Information.  Is information we automatically collect from you when you visit our Website.  This includes internet protocol (“IP”) addresses, browser type, internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and/or clickstream data.  This information is collected from the use of cookies, web beacons, or JavaScript.

1.1.7.   No Information Collected from Children.  We will never knowingly collect any Personal Information from children under the age of 16.  If we obtain actual knowledge that we have collected Personal Information about a child under the age of 16, that information will be immediately deleted from the database.  Because we do not collect such information, we have no such information to use or to disclose to third-parties.

1.1.8.   Credit Card Information and Bank Account Information.  We may, in certain instances, collect credit card number(s), bank account information, and related information, when you place an order on our Website.  When the credit card or bank account information is submitted to us, such information is encrypted and is protected with SSL encryption software.  We will use the credit card information or bank account information for purposes of processing and completing the transaction you requested through a third-party processor.  As such, information will be disclosed to third-parties as necessary to complete the requested purchase transaction.

We may combine, de-identify, or aggregate any of the information we collect for any purpose. We may also receive deidentified information from third parties. We will take reasonable measures to ensure deidentified information cannot be associated with a consumer of household. We also commit to maintaining and using this information in deidentified form and not to attempt to reidentify the information, except as permitted under applicable law.

2.2.      Web Beacons.  We use electronic images known as Web Beacons (sometimes called single-pixel gifs, clear gifs, or action tags) which allow us to collect information about your visit to our Website, measure and improve the effectiveness of advertisements, and track delivery of advertising.  Web beacons collect only a limited set of information including a cookie number, time, and date of page view, as well as a description of the page on which the web beacon resides.  We may also use web beacons in email messages sent to you.  This allows us to determine if you opened or acted upon the email message.  Because web beacons are the same as any other content request, you cannot opt-out or refuse them.  However, they can be rendered ineffective by either opting-out of cookies or changing the cookie setup in your browser.

4.1.5.   Legal Process.  We disclose your information, if legally required to do so, or at our discretion, pursuant to a request from a governmental entity, or if we believe in good faith that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights, property, or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.

4.1.6.   Acquisition or Merger.  We may disclose and transfer your information to a third-party who acquires any or all of our business, whether such acquisition is by way of merger, consolidation, or purchase of all or a substantial portion of our assets.  In the event we become the subject of an insolvency proceeding, whether voluntary or involuntary, we, our liquidator, administrator, receiver, or administrative receiver may sell, license, or otherwise dispose of, such information in a transaction approved by the court.

  1. Security.

5.1.      We endeavor to safeguard and protect your information.  We have security measures in place to help protect against the loss, misuse, and alteration of personal information under our control.  Please be advised that, although we take commercially reasonable technological precautions to protect your data, no data transmission over the Internet can be guaranteed to be 100% secure; therefore, we cannot and do not warrant that your information will be absolutely secure.  Any transmission of data at or through our Website is at your own risk. However, access to your information is strictly limited and not accessible to the public.

5.2.      When our website include functionality that allows you to register a profile or account, we may allow you to remain logged in so that you do not have to re-enter your password each time you want to access your account.  If you choose to remain logged in, please note that anyone with access to your device will be able to access and make changes to your account and may be able to make purchases through your account.  For that reason, if you choose to remain logged in, we strongly recommend that you take appropriate steps including enabling a “Passcode Lock” security feature on your mobile device to protect against unauthorized access to and use of your account.  Please also notify us as soon as possible if you suspect any unauthorized use of your account or password.

Where permitted by law, we verify requestors’ identities before fulfilling requests to learn about our processing of Personal Information (including learning about the specific pieces of information we collect), rectification of Personal Information, and requests regarding the deletion of Personal Information by matching information provided by the requestor to the Personal Information that we already have for that individual. Consumers will need to provide their email addresses.

Authorized agents may need to provide documentation proving that they are authorized to exercise rights on behalf of the consumer whose Personal Information is subject to the request. We may notify the consumer and require the consumer to independently verify their identity before fulfilling the authorized agent’s request.

8.5.      How to submit requests to opt-out of sales or the processing or sharing of information for targeted advertising. In addition to the methods provided above, you can submit an opt-out request by clicking Do Not Sell or Share My Personal Information on the website. We may disclose your information even if you opt-out of sales if such disclosures do not constitute “sales” under your State’s respective privacy law.

8.6.      Notice of Financial Incentive.  We may offer our customers a loyalty program that provides certain perks, such as rewards and exclusive offers.  We may also provide other programs, such as sweepstakes, contests, or other similar promotional campaigns (collectively, “Promotions”).  When you sign up for one of these Programs, we ask you to provide your name and contact information (such as email address and/or telephone number).  Because our Programs involve the collection of Personal Information, they may be interpreted as a “financial incentive” program under the California Consumer Privacy Act (“CCPA”). The value of your Personal Information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Promotion, less the expense related to offering those products, services, and benefits to Program participants.

Participation in these Promotions is entirely optional. You may withdraw from participating in a Program at any time by contacting us using the designated method set forth in the applicable Program rules.  The terms and conditions page of each Promotion will detail how to withdraw from participation.
